The Little Club (TLC) Terms & Conditions
Please read these Terms and Conditions carefully before booking any Pre-Booked Days with The Little Club Ltd ("TLC"). By making a booking, you agree to be bound by these Terms.
Terms and Conditions for Provision of Services
The Little Club Limited (“TLC” or “we/us/our”) provides woodland and outdoor experiences for children. These Terms and Conditions (“Terms”) govern the provision of our services for Pre-Booked Days, including but not limited to activity days and holiday camps (the “Services”).
These Terms, together with the Confirmation Email and our Privacy Notice, form the basis of the Contract between you (the “Client”) and TLC.
1. Definitions and Interpretation
In these Terms:
· "Client" means the person making the booking.
· "Pre-Booked Day" means a scheduled event organised and run by TLC, for which a place has been reserved in advance.
· "Services" means the activities and supervision provided by TLC in connection with a Pre-Booked Day.
· "Confirmation Email" means the booking confirmation issued by TLC confirming the Client's Pre-Booked Day.
· "Price" means the total cost payable by the Client, as specified in the Confirmation Email.
No variation to these Terms will be binding unless agreed in writing. If there is a conflict between these Terms and the Confirmation Email, the Confirmation Email shall take precedence.
2. Formation of Contract and Cancellation
A binding Contract is formed when:
· TLC issues a Confirmation Email, and
· The Client submits payment (whether in part or in full), or TLC incurs any cost in preparation for the Services.
Cancellation Policy (Refunds):
· 30 days before: full refund
· 14–29 days before: 50% refund
· 13-8 days before 25% refund
· 7 days or less: No refund
Refunds are subject to deduction of any non-refundable third-party costs incurred by TLC.
Requests to cancel or reschedule a Pre-Booked Day must be made in writing and are subject to TLC’s approval and availability. Booking changes may incur an administration fee of £25 per pre-booked day.
3. Price and Payment
The Price for each Pre-Booked Day is stated in the Confirmation Email or published on our website and booking forms. All prices are exclusive of VAT, unless stated otherwise.
TLC reserves the right to adjust the Price if:
· There is a change in the number of participants.
· There are delays, errors, or omissions in information provided by the Client.
Payment is due upon booking unless otherwise agreed in writing. TLC reserves the right to withhold or cancel services where payment is outstanding.
4. Provision of Services
TLC will:
· Deliver the Services with reasonable care, attention, and professionalism.
· Ensure staff are appropriately trained, experienced, and DBS-checked.
· Comply with all applicable laws and child supervision ratios.
If the Pre-Booked Day is held at a location provided by the Client (e.g. private land), the Client is responsible for ensuring:
· The site is safe, clean, and suitable.
· TLC has reasonable access for set-up and delivery.
· Any relevant site-specific risks or issues are disclosed in advance.
TLC reserves the right to cancel or relocate the Pre-Booked Day if the location is deemed unsuitable or unsafe.
5. Safety, Supervision, and Safeguarding
The Client must provide accurate and complete information regarding their child/children, including:
· Allergies
· Medical conditions
· Emergency contact details
· Special educational or behavioural needs
Children must be dropped off and collected on time. Late collections may result in additional charges.
TLC Pre-Booked Days are designed for children aged 5 years and over. We do not accept children under the age of 4. Acceptance of 4-year-olds is at the sole discretion of TLC and will be confirmed in writing.
TLC reserves the right to remove any child whose behaviour endangers others, disrupts the day, or breaches our safeguarding policies.
TLC’s staff are trained in basic first aid and may administer first aid where necessary.
We are committed to the safeguarding and welfare of all children and have detailed policies and procedures in place to protect them. All staff receive safeguarding training and are subject to enhanced DBS checks.
6. Data Protection and Privacy
TLC complies with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.
· We collect only necessary personal and sensitive data to deliver our Services safely and legally.
· Personal data is processed securely and is not shared with any third parties.
· Our Privacy Policy is updated and shared each time you book onto a new Pre-Booked Day via the form issued through Google Forms. By submitting this form, you consent to the updated policy and data handling.
You may contact us at any time to request access to, or deletion of, your data in accordance with your legal rights.
7. Promotional Material and Photography
TLC may from time to time take photographs or videos during Pre-Booked Days to be used for promotional purposes, including on our website and social media.
You will be given the choice to opt in or opt out of photography and promotional use on the booking form issued via Google Forms at the time of booking.
8. Limitation of Liability
TLC holds appropriate public liability insurance. However, to the fullest extent permitted by law:
· We shall not be liable for any loss or damage suffered by the Client or any child, including indirect or consequential loss, except where caused by our negligence or breach of duty.
· We shall not be liable for loss or damage to personal belongings brought to Pre-Booked Days.
· Children participate at their own risk, and appropriate behaviour and clothing (as advised in the Confirmation Email or booking form) are expected.
Nothing in these Terms limits our liability for death or personal injury resulting from our negligence or for any liability that cannot be excluded under applicable law.
9. Force Majeure
TLC shall not be in breach of these Terms or liable for any delay in performance of, or failure to perform, any of its obligations where such delay or failure results from events, circumstances, or causes beyond its reasonable control. This includes, but is not limited to:
· Acts of God
· Adverse weather
· Government restrictions
· Fire or flood
· Pandemic or epidemic
· Illness or injury to key staff
Where possible, TLC will seek to reschedule or offer credit for future Pre-Booked Days in such cases, but cannot guarantee refunds outside our standard cancellation policy.
10. Behaviour and Removal Policy
TLC reserves the right to exclude any child or terminate participation at any time if, in our reasonable opinion, a child:
· Causes disruption that significantly affects the experience or safety of others
· Poses a risk to themselves or others
· Fails to comply with reasonable instructions
No refunds will be given in such cases. Parents or guardians will be contacted immediately and must arrange collection.
11. Intellectual Property
All content, materials, branding, logos, and creative assets used in connection with TLC and its Pre-Booked Days remain the intellectual property of The Little Club Ltd. They may not be used, copied, or reproduced without our express written permission.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales.
Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
